Terms & Conditions

Commissions and work carried out by Richard Roberts are subject to the conditions below. These cannot be varied in any way by the client unless expressly agreed by the photographer in writing. The terms of the right of the client to reproduce and display the images for the purposes described below. Terms & Conditions: Explanation of terms: In the following conditions of contract “the photographer” shall mean Richard Roberts trading as Richard Roberts Photography, 183 Route Du Buisson, Le Grenier, 73120 Courchevel, France. “The images” refer to those commissioned by the client from the photographer within the terms of this contract. “The client” shall be the person or business whose name appears on the invoice. “The photographer” shall also mean “the videographer” and “the images” shall also mean“the videos” where video services have been agreed. Conditions of contract: 1) Copyright and License to Display a) The "Copyright Designs and Patents Acts" and "Code de la propriété intellectuelle" Articles L111-1 à L811-6 automatically assign the copyright and intellectual property of a photographer’s images to the photographer. Intellectual property and copyright of the images referred to in this contact will always remain with the photographer under usual copyright law, unless agreed under separate contract and payment terms agreed by the photographer. b) This agreement gives the client the right to display and reproduce the images within the specific terms outlined below. 2) Terms of the client’s license to display and reproduce the images: ​ Property Photography a) Where intended use of images is to promote a specific rental property, the license to use the image continues only for the duration of the property’s rental agreement with the client. If the client wishes to extend the license after the rental agreement is terminated, the client must request permission from the photographer. b) The client has exclusive license to display and reproduce the images owned by the photographer. The client may not sell or gift this license to another commercial or editorial enterprise unless by arrangement in writing with the photographer. c) Where the images are unrelated to a specific property but are used to promote the client’s business, the license to reproduce and display the images is granted for a term of 5 years. d) A renewed agreement must be reached with the photographer should the images be used for a different purpose or after the agreed license has expired. e) Where an image is to be used in an editorial context to promote the client under an arrangement where no fee has been made to guarantee publication, the client must inform the photographer and be credited as the copyright owner. 3) Photographer’s rights a) As copyright owner, the photographer retains limited rights to use the images only for promotion of the photographer’s own business through digital or print means. This limitation exists for the terms of the client’s license to display and reproduce the images. b) The client is not permitted make any addition too, deletion from or alteration to the images without written permission from the photographer. c) If the client (i.e. the client’s business/enterprise/society etc.) ceases to exist, then the license to display and reproduce the images also ceases to exist. Should the client’sbusiness/enterprise/society etc. change ownership, then the new owners must contact the photographer if they wish to renew the license. 4) Invoice terms and booking conditions a) Payment terms are strictly 30 days, unless agreed in writing with the photographer. Only upon full and final payment of the invoice, does the client receive the images and the license to display and reproduce. b) Cancellation fees apply 50% of the agreed quote for cancellation of the shoot within 48 hours of the date and time agreed and any costs incurred, costs may include specific equipment purchased or hired for use during the shoot.
